On Monday, October 7, the Francis Howell School District filed a lawsuit against Juul, manufacturer of e-cigarettes and vaping products. The District does not c...omment on pending litigation, but the following statement from District attorney Cindy Ormsby provides some information and context for our stakeholders. In the past five years, the Francis Howell School District has been forced to deal with the issue of students’ increasing addiction to nicotine as a result of vaping. There were 54 nicotine-related infractions among students at Francis Howell in 2015, compared to 248 last year, including three elementary school cases. Student use of e-cigarettes is directly related to Juul, Inc. marketing to kids too young to legally purchase nicotine products. As a result, significant time, effort, and resources are being expended to address this ever-growing issue affecting our students. The FHSD Board of Education decided to take the bold move of holding Juul responsible for this epidemic by filing this lawsuit. It is important, however, to know that no District funds are being used in pursuing Juul to assist in addressing an issue they created. All attorney fees and costs will be paid only if the lawsuit is successful, and Juul is required to address these concerns. All fees and costs would come out of any recovery received from Juul. At no point will taxpayer dollars be used in pursuing this lawsuit.
