Yesterday we remembered our veterans. Let's also remember our founding fathers (many of whom were veterans), who in 1791 amended the US Constitution to add the 7th Amendment. The 7th Amendment was added because the founding fathers did not want the Legislative, Executive, or Judicial Branches to be able to interfere with a jury's determination of liability and damages. Their idea was that all citizens would be co-equals because any person could be judged by their peers and... nobody was supposed to be able to interfere with the jury's determination. The 7th Amendment states: "In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law." Juries determine two facts: 1) who is liable; and 2) the amount of damages. Yet, in the USA today, special interests have successfully lobbied the Legislative branch to enact laws that eliminate (e.g. granting immunity) or change (e.g. putting an arbitrary cap on) the jury's determination of the amount of damages. "Tort Reform" is nothing more than big businesses and insurance companies taking away your Constitutional rights. If you are in favor of the US Constitution then you should be in favor of protecting the 7th Amendment. That means ending the assault on consumers by big businesses and insurance companies. That means demanding that the Legislative Branch stop trying to eliminate suits at common law and stop trying to cap damages. That means demanding that the Executive branch appoint judges who will uphold the 7th Amendment instead of caving to big business and insurance companies.
