My yearly reminder. FAMILY LAW REMINDER: As the holidays approach, we take more and more calls from parents with custody disputes. Most calls are about whose "time" it is - please remember that it is not "your time" or "their time." It is your child's time - they get one childhood. When parents are constantly fighting about time and other issues, they are creating childhood "memories" for their children. These children learn that their parents are always angry at each other ...because of "custody." Children then believe that "if it weren't for me (or us) my parents would be happy. They always fight and get angry about me." These are not the holiday memories we want children to take into adulthood. Except when there are REAL safety concerns, the Court expects you to let your children participate in BOTH families. This may not always be convenient, or your desire, but your children want to love both their parents without feeling guilty or being forced to choose a side. It took two people to make the child, and that child wouldn't exist without both parents. When you are spewing anger and hatred about each other you are telling your child half of them is BAD. That is not fair to a child. Keep your opinions to yourself, and let your children enjoy being children. If you are asked to rearrange parenting time, please ask yourself if you are refusing the request because IT IS BEST FOR YOUR CHILD. If you are refusing because it is unfair to you - reconsider. The court is only interested in what is in the "best interest of the child." They are not looking for what is fair to parents. Please keep this in mind over the holidays, as there aren't many children who do not want to be included in the fun and festivities of their families. Let them be loved and enjoy their holidays with BOTH parents when possible. You will never have too many people love a child! Your children will thank you!

This article has generated a number of questions from clients. It would appear that prisoners are eligible for the stimulus, and will receive those funds. However, those funds are also subject to garnishment for back child support. That is the only reason the funds can be held, in full or in part. For those asking if they will receive the stimulus for their back support, the answer is YES. You will receive the stimulus check through the Family Support Center when funds... are finally released. I can’t say when that will be, but so long as nothing changes this ruling, you will get them. Hope this helps! https://fox2now.com//fox-files-missouri-inmates-will-be-g/ See more

A Blog Post on how COVID-19 is impacting the legal world.

Martin Law Office, PC 04.09.2020

Dear past, present and future clients: Based on the current situation with COVID-19, and a confirmed case in Jasper County it is time for us to make some changes to our office practices. Martin Law Office will be open and available to meet your needs in a timely and efficient manner. However, to protect our clients, staff and community, and to assist in limiting the spread of the COVID-19, we will be adjusting how we provide services as follows:... 1. We ask that only clients who have PRE-SCHEDULED APPOINTMENTS attend at the office. Please do not simply drop in. Also, if you are attending our office in person please adhere to the guidelines: 1. DO NOT attend if in the last 48 hours you have experienced a cough, fever, or difficulty breathing; 2. DO NOT attend if you have travelled in the last 14 days. 2. We encourage clients, where possible, to utilize the option of teleconference or email instead of attending our office in person. We have recently upgraded our technology to make our clients lives easier and as such are fully prepared to meet your needs remotely. In addition to video, phone and email we now have a secure text message option. You may text (417) 815-6195. 3. We ask clients who need to provide us documents to do so by scanning and emailing a copy, send through DropBox or simply drop it in the receptacle inside the lobby to the right of the entrance. We will also provide envelopes for payments to be dropped. Please DO NOT open the reception window to hand the document or payment directly to staff. Credit card/debit card payments may be called in to the office. 4. We will NOT be providing any other drop-in service at this time. You must call the office and schedule a time to come in, so that we can adhere to all CDC guidelines for the number of people allowed in the offices with social distance being observed. It is our intention to limit the flow of clients into our building to only that which is absolutely necessary so as to protect ALL clients and staff. We are committed to keeping you and our staff safe, as such we have increased our cleaning/disinfecting protocols for public areas. We ask for your patience during this time of altered service as our staff attempt to meet the needs of clients and their families. As always, Martin Law Office is where clients are treated as friends with honesty and integrity. We pray for the health and safety of each of you, and promise you we will continue to do our part during a trying time for all. If you have any questions or wish to book an appointment, please call (417) 782-5900.
