In the post I discuss a court of appeals case involving Conagra as employer in which they said worker Jon Phillips, who fell on a slightly angled ramp and went down on his hip and leg, injuring both. The appeals court upheld the decision of the administrative judge who heard the case and found the fall and injury to be work-related an...d granted him Missouri workers’ comp benefits. Conagra kept appealing the decision, arguing that since Phillips had previously fractured the knee his leg could have just as easily collapsed off work and that the cause of the accident was unknown, either one making it a non-work-related injury. My latest post discusses how you would usually need your own medical expert to read the company doctors' treatment records on you, interview and examine you, and write a report on the injuries and permanent disability you suffered for your work accident or exposure. Then your expert would have to be ready to testify for yo...u at a deposition at which the insurance company's attorney could question him. Otherwise whatever the company doctor says goes unchallenged. The doctors they send you to will always either deny or minimize your work injuries, release you way too soon, and say you suffered little or no permanent disability you could get paid benefits for. The post talks about a Missouri court of appeals case, Bierman v. Violette, in which the injured worker was allowed to proceed with a separate negligence lawsuit against a coworker who set up a ladder for her to climb down on without safely locking it into place in addition to pursuing a workers comp claim against her employer. ...Normally you aren't allowed to do both, but this case was an exception. When Bierman stepped down onto the ladder it collapsed and Bierman fell down onto a concrete restaurant counter below, seriously injuring herself. Normally workers hurt on the job can only file claims against their employers for workers' comp but are barred from filing negligence lawsuits in court against the company, management or their coworkers. Ms. Bierman was allowed to continue with her lawsuit only because of the separate act of negligently setting up the ladder so that it was sure to collapse under whoever was using it.
