However, new normal seems to have s...everal meanings, and the meaning varies depending on where you are and how you have been affected by COVID19. Locally, our New Normal has included seeing so many things important in our daily lives being closed; institutions like our Churches, our schools, our favorite restaurants and watering holes. We have watched our kids’ sports seasons either cancelled or truncated. Our courts have closed. Our stores have changed their hours and their normal, daily business practices. We have experienced job losses economic difficulties. And, before this year, most of us thought social distancing meant seeing that relative only at the annual family gathering or blocking that person from our social media. As we find ways to acclimate and adjust to the New Normal, it seems experts have agreed there are a few things we can do individually to ideally shorten the time we live under these strange new rules, e.g., (a) we can regularly wash our hands, (b) we can exercise social distancing, (c) we can avoid others when we aren’t feeling well, and (d) we can wear face masks. In so many parts of our public lives wearing face masks is becoming mandatory. We’ve all tried various models of face masks from a bandanna we pulled from our sock drawers to the $1 masks we get at the checkout counter. The most common face mask models we see around do not fit well, they break after a few wears, they muffle our efforts to speak, and they fog up our glasses. Congratulations to our law partner, Scott Fulford, and to our client. As per an earlier post, our client had pleaded guilty and received an SIS on an ignition interlock issue. Thereafter, the Mo. Dept. of Revenue overreached and suspended our client's license for a year. We, on behalf of our client, challenged the DOR in state court and won. ... DOR then filed an appeal. The Missouri Court of Appeals (Eastern District) issued it's decision earlier today, finding in favor of our client and affirming the trial court's earlier decision. In its opinion, the Court stated: "Based on the plain and ordinary meaning of section 302.462.1, we hold 'a finding of guilt to a violation of section 577.599' and a 'conviction' with respect to such an offense is required before a one-year revocation of a person's driving privileges can occur." The Court, therefore, stated the DOR did not have the authority to revoke our client's driving privileges, as it had tried to do. From our research, Scott's case was the first to address this issue. So, congrats to our law partner, Scott Fulford, for the outstanding legal work in this case.
