The best thing about having a Trust is that you get to decide at what age your beneficiaries receive their money! A Trust can avoid the inflexibility of conservatorship that passes assets to the children at age 18. The Trust agreement can indicate any age (25, 30, and so on) at which the trust terminates and assets pass to the children. The Trust document states how parents wish the money to be spent, who should be the Trustee, and when the trust should terminate so assets p...ass to the children. The Trustee has the responsibility of following the parent’s directions for health, education and support of the children as outlined in the Trust agreement.
