Weight of the Evidence Showed Substantial Change in Circumstances On motion to modify custody, statutes require proof of a change in circumstances. Judicial admissions eliminate the need for credibility determinations and showed that, after divorce, respondent neglected children’s dental, vision, medication, and hygiene needs. In that context, respondent’s denial of abuse and recent acquisition of toiletries did not carry probative force. Circuit court’s conclusion, that ...no change in circumstances occurred, was against the weight of the evidence. Reversed to determine whether child’s best interest supports change in custody.
