HOSPITALS LOSE LEGAL BATTLE TO STOP THE TRUMP ADMINISTRATION FROM FORCING THEM TO REVEAL THE PRICES THEY CHARGE INSURERS by Kevin Ryan The American Hospital Ass...ociation lost its legal bid to stop the Trump administration from requiring hospitals to disclose the secret rates they negotiate with insurance companies, a victory for one of President Trump’s central health policy initiatives. The association representing 5,000 hospitals and health networks sued the Trump administration over a new federal rule that would require them to disclose the prices they charge insurers, saying it would violate their First Amendment rights. The administration hopes the new rule would allow patients to better shop for deals on a range of services. Patients have long complained that they are completely in the dark about what a doctor’s visit or surgery will cost until after they receive the bill. Knee surgery, for example, can cost thousands of dollars more at one hospital than at another in the same region. Hospitals should be ashamed that they aren’t willing to provide American patients the cost of a service before they purchase it, said Caitlin Oakley, a spokeswoman for the Department of Health and Human Services. The administration has been attempting to increase pricing transparency as a way of fighting rising hospital costs, but has faced opposition. When the administration earlier tried to require pharmaceutical companies to disclose the list price of prescription drugs in television ads, Judge Amit P. Mehta, an Obama appointee, struck it down. The ruling today comes from Judge Carl Nichols of the U.S. District Court for the District of Columbia, a Trump appointee.
