So we go from 4 degrees with snow and ice to the 50's and 60's with rain rain rain in less than 30 days. Yep, we're in the St. Louis area. We might not be worried about ice but rainy conditions bring dangerous driving conditions from possible hydroplaning (even at lower speeds depending on your tires) to low visibility. Be careful out there. If someone else out there is not careful, we're here to help

People are surprised to learn that GENERALLY, a landowner has no legal obligation to shovel snow or ice. In Illinois, the courts use the natural accumulation rule. An owner or possessor of land has no duty to remove natural accumulations of ice, snow, or water on its property. However, it is important to remember that there are exceptions to this rule in both Missouri and Illinois. In both states, there are some city ordinances that may require a homeowner to clear their si...dewalks after a snowfall. In Illinois, there are state laws that may apply. In addition, if a landowner chooses to clear parking lots or walkways, they have a responsibility to make sure they have done so safely. In an apartment complex, the complex is probably responsible for the common grounds. Anytime I talk with someone who has fallen on ice, I explain that we need to investigate whether or not the ice was due to an unnatural accumulation. For example did the possessor of land create the problem with a gutter emptying water onto a walkway allowing it to freeze creating an unnatural accumulation or by allowing a "cleared" walkway to "refreeze". It's important to talk with an attorney who handles these type of cases BEFORE giving any type of statement. As always, we're here to help See more
