Today, the Supreme Court of Missouri granted Jonathan Sternberg's request for a preliminary writ of prohibition challenging wh...ether, years after a case is over, a party can be ordered to provide privileged records to his opponent because the opponent believes a finding in the case was mistaken. A trial court ordered a party in a domestic case that had been closed for four years to give his opponent total access to all his privileged military medical, employment, and psychological records because the opponent argued that the amount of his retirement pay he previously was found to have accrued seemed too low. The Supreme Court's order agrees to decide - after further briefing and argument - whether this is lawful. The case is State ex rel. Cullen v. Harrell, No. SC97008. See more

Yesterday, the Supreme Court of Missouri granted Jonathan Sternberg's request for a preliminary writ of prohibition challenging whether the state Constitution a...llows a court to force private attorneys to represent litigants in juvenile cases without pay. The Constitution guarantees that "all persons have a natural right to ... the enjoyment of the gains of their own industry", which previously has been held to bar the government from forcing private businesspeople to work without pay. Jonathan represents an employment lawyer who the Jackson County Family Court appointed under its peculiar system to work for free at the State's behest.
