DIVORCE: WHAT NEEEDS TO HAPPEN: People live separate and apart when they get divorced. We can't finish your parenting plan, or your divorce, until we know where both parents are going to live. It would be best if you and your spouse discussed how & where the two of you are going to live separately, so you can then finalize a parenting plan. Are you keeping the house, where is your spouse going to live and when will they move out? Will you refinance the house to remove their ...name from the mortgage? Does your spouse want the house sold? There are only 2 ways to get divorced. You and your spouse come to an agreement or we go to trial - which is very expensive. I strongly suggest you have these discussions. You two will have to co-parent for many years. Co-parenting should start now if possible. If not, your divorce will take a lot longer and be a lot more expensive than you desire. Its your life. Your family. You and your spouse ideally should be making these decisions. Thinking or wanting a judge or your lawyers to make decisions is not the best course of action. Some people just can't decide or want the judge to decide. I see this pretty often. It is very inefficient, unrealistic and expensive.
What is family law? The most common, is filing for divorce. People have children out of wedlock and when they split-up, a paternity case is filed to address custody and child support. In both divorce and paternity, the court retains jurisdiction to address child support and custody issues. This type of case is called a Modification and arises when a substantial and continuing change of circumstances arises.
