An opinion was rendered yesterday in United States v. Rodney Foster, a federal criminal appeal in the United States Court of Appeals for the Eighth Circuit. I was also co-counsel with John Picerno during trial in the United States District Court for the Western District of Missouri. I argued the fact that the government failed to prove 1) the Defendant and his co-conspirators knew the identity theft victim was a real person, 2) the alleged identity theft victim that testified... at trial did not sufficiently identify himself as the victim, and only provided his name, 3) and the government failed to meet its burden of proof. We didn't win the appeal, but the 8th circuit did render a 9 page published opinion. You can check it out at the link below. Okay while on the train of thought regarding "ethical" and "fair" professionals, I can't help but share another page that I HIGHLY recommend (that you "LIKE" the page, and not just this post). I was just appointed to another federal criminal case in the Western District of Missouri by Judge Sarah Hays, the Magistrate who ruled in my favor in my motion to suppress recorded phone calls in U.S. v. Frank G. Hawkins: http://mo.findacase.com//xq/fac.20130409_0000294.WMO.htm/qx The new case is U.S. v. Brian K. Brewer, aka "Sneak", case no. 5:13-cr-06016-GAF. The defendant is charged by way of a 7 count indictment, 1 count of felon in possession of a firearm, 2 counts of illegally dealing firearms, 3 counts of distribution of crack cocaine and 1 count of carrying/brandishing a firearm during the commission of a violent felony offense. Should be a fun case!

United States v. Michael Scott, 8th Circuit Appeal No. 12-3131, Western District of Missouri No. 10-00027-01-CR-W-DGK. Appellant, through counsel William Kenney, raised three points on appeal: 1) the District Court erred in improperly joining three counts of Bank Robbery, and erred in failing to sever the counts upon the motion of the Defendant, 2) the District Court erred in denying Scott's Motion to Suppress the evidence found in his Jaguar due to invalid third party consen...t, and 3) the District Court's departure from the guidelines and imposition of two concurrent life sentences was substantively unreasonable, given the age of the Defendant at the time of sentencing. Chief Justice Riley delivered the opinion of the Court affirming the judgments of conviction, with Justice Bright filing a dissent on the sentencing issue. http://media.ca8.uscourts.gov/opndir/13/10/123131P.pdf

The dependable attorney(s) of Bill Kenney Law Firm are working away at their first petition for writ of certiorari to the United States Supreme Court. The status of the firm would skyrocket if United States v. Diamond D. Blair, WDMO Case No. 10-00093-01-CR-W-DW, 8th Cir. Case No. 12-1927, was heard in the Supreme Court. Keep your fingers crossed that this case will be one of the .75-.80 percent of cases heard!
